Elimination of the Ministry’s list of experts and attestations

As of April 12, 2023, attestations accompanying land characterization studies and other documents submitted under Division IV of Chapter IV of the Environment Quality Act (EQA) will no longer be required. In addition, the Ministry’s list of experts qualified to produce these attestations will no longer be used.

Instead, the documents concerned will need to be signed by one of the following:

  • A professional who is a member in good standing of a professional order;
  • A person certified in the land characterization and rehabilitation field by an organization accredited by the Standards Council of Canada under ISO 17024. The only organization that is currently accredited in Québec is the Québec Association of Environmental Auditing (AQVE – Association québécoise de vérification environnementale).

Verifying the proficiency and compliance with ethical rules of the signatories will be ensured by one of the professional orders or by the AQVE, as appropriate.

Until the entry into force of these new provisions with the adoption of Bill 102, the Ministry will continue to receive attestations from experts, which are still currently required.

Experts on the Ministry’s list and contaminated land management consultants therefore have until April 12, 2023 to comply with the new requirements.
